1. Definitions

Terms in this Privacy Policy are defined as follows:-

“Feedback” means detailed information you provide about Training Providers and the services they have delivered to you.

“Partners” means those organisations with which we have an established partnership.

“Personal Information” means any information, which identifies you as an individual or from which you could be identified by a third party (including but not limited to first name, maiden name, last name, username or similar identifier, marital status, title, date of birth and gender). It also includes anonymous information about your computer and your visits to coursecheck.com.

“Public Feedback” means overall comments and ratings that you agree to us making public on our Website.

“Reviewer” means you, the person leaving feedback about the service provided by your Training Provider.

“The Data Protection Act” means The Data Protection Act 2018 and any subsequent amendments to it including the rights and obligations as set out in the EU General Data Protection Regulations (GDPR).

“Training Provider” means the organisation that has provided training services to you.

“we”, “our”, “us” means Coursecheck Ltd, a company incorporated in England and Wales (No. 08324937) and having its registered office at Yew Tree House, Lewes Road, Forest Row RH18 5AA.

“Website” means the website at www.coursecheck.com and any other web sites owned by Coursecheck Ltd.

“you”, “your” includes anyone you represent and on whose behalf you provide information to us.  This includes any person, firm, company, unincorporated association or any other legal entity.

2. Introduction

We are the data processor (as defined in The Data Protection Act) in relation to your personal data.

We are committed to ensuring that Feedback and Personal Information provided by you, is securely held and we only hold data that is essential to the provision of our service.

Coursecheck Ltd is listed with the Information Commissioner's Office on the Data Protection Public Register with registration number ZA056850.

This Privacy Policy explains how we use the Feedback and Personal Information that you provide to us, and how we collect, store and organise this information, or do anything else to it that would be considered data processing under The Data Protection Act.

By disclosing your Personal Information to us, you consent to the collection, storage and processing of your Personal Information as stated in this Privacy Policy.

This Privacy Policy aims to give you information on how we collect and process your personal data through your use of this Website, including any Personal Information you may provide through this website when you submit Feedback.

This Website is not intended for children, and we do not knowingly collect data relating to children.

  2. Feedback that you give about the training you have received.
  3. Anonymous information about your computer and your visits to our Website including your computer’s IP address, geographical location, browser type, referral source, length of visit, number of page views and information about how you navigate around our Website.
  4. Marketing and communications data including but not limited to your preferences in receiving marketing from us and our third parties and your communication preferences.

4. Why we collect information and how we use it

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
  • Where we need to comply with a legal obligation.

We collect Personal Information to help us ensure the integrity of the Feedback on our Website; and also to share with your Training Provider so that they can communicate with you if necessary to discuss your Feedback.

Personal Information submitted to us via our Website will be used strictly in accordance with The Data Protection Act and as otherwise permitted or required by law.

We will never publish any Personal Information on the public areas of our Website without your prior explicit consent, except for your first name and the initial of your last name.

Any Personal Information you provide will be accessible to your Training Provider but how they use it will be governed by their own privacy policy, for which we are not responsible.

We have set out below, in a table format, a description of all the ways we plan to use your personal data, and which of the legal bases we rely on to do so. We have also identified what our legitimate interests are where appropriate.

Note that we may process your personal data for more than one lawful ground depending on the specific purpose for which we are using your data. Please contact us if you need details about the specific legal ground we are relying on to process your personal data where more than one ground has been set out in the table below.

By submitting Feedback, you acknowledge and agree that we may use your Personal Information to:

  1. Send you a confirmation email after you have submitted your Feedback.
  2. Inform you if your Training Provider has responded to comments in your Feedback.
  3. Send you requests for additional feedback if we are requested to do so by your Training Provider.
  4. Respond to enquiries and complaints made by or about you relating to the Website.

We collect Feedback and share it with Training Providers to help them improve their services and promote their services.  To do this, we display Public Feedback on the public area of our Website and in aggregated form on the websites of Training Providers and our Partners.

When submitting Feedback, you have the option to specify that it should not be made public.  If you specify that it can be made public but later wish to remove it from public view, you may email us at support@coursecheck.com and we will action your request as soon as reasonably possible.

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you. Four years after the date on which you submitted your Feedback, we will delete any information that could be used to identify you and retain only your Feedback together with your first name and the first letter of your last name.

5. Your Rights

You have the right to view, amend or delete the Personal Information we hold about you, free of charge, and can request any of these actions by emailing us at support@coursecheck.com.

We will endeavour to respond promptly to all such requests and in any event, within the statutory time limits.  However, in order to fulfil any such requests, we may need you to provide us with information to enable us to confirm your identity.

You have the right to:

Request accessto your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

Request correctionof the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

Request erasureof your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

You also have the right to object where we are processing your personal data for direct marketing purposes. Request restriction of processingof your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:

  • If you want us to establish the data's accuracy
  • Where our use of the data is unlawful but you do not want us to erase it.
  • Where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims.
  • You have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

Request the transferof your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

Withdraw consent at any timewhere we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. We will keep all Personal Information about you on our secure servers and will take reasonable technical and organisational precautions to prevent the loss, misuse or alteration of your Personal Information.

In the event of any incident that we become aware of, that results in any unauthorised access to your Personal Information, we will promptly inform you using contact information with which you have provided us. We will also notify any applicable regulator of a breach where we are legally required to do so.

We may disclose information about you to any of our employees, officers, agents, suppliers, partners, subcontractors or other third parties insofar as reasonably necessary for the purposes as set out in this Privacy Policy or whom we have appointed to process information on our behalf or manage aspects of our Website. This Privacy Policy is governed by and construed in all respects in accordance with English law and we submit to the exclusive jurisdiction of the English Courts.

Our Website and email communications may contain links to other websites. We are not responsible for the privacy policies or practices of third-party websites, including use of cookies on such third party websites and you should refer to the third party’s privacy policy for more information.

Our Website includes social media features (“Features”), such as the Facebook Like button and Widgets such as the “Share” button. These Features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly.
